This website is published by The Orchard Reserve LLC (“we”, “us”) for general information about The Orchard Reserve at Indian Lake. By accessing or using the site you agree to these terms. If you do not agree, do not use the site.

You must be at least 18 years old, and legally able to enter into a binding agreement, to use this site or to submit information through it.

The Orchard Reserve is in planning. Everything shown on this site about the intended development — including site plans, homesite concepts, boundaries, dimensions, acreage, shoreline treatment, docks, roads, utilities, amenities, standards, phasing, release timing and pricing — is preliminary, conceptual and subject to change.

Specifically, and without limitation, you acknowledge that as of the effective date of these terms:

• No governmental entitlements, zoning approvals, subdivision approvals, permits or variances for the development have been obtained.
• No final plat has been recorded, and no homesite has been legally created.
• Engineering and survey work is not complete, so no boundary, dimension or acreage shown or described anywhere on this site is final.
• Any dock, dockage, mooring or shoreline right is subject to the approval and continuing regulation of the Ohio Department of Natural Resources and any other authority with jurisdiction. Dockage approvals are pending. No dock right of any kind is granted, promised or assured by this site.
• Depictions of any improvement, feature or amenity are illustrative of intent only. They are subject to governmental approval, may be modified, and may never be built.

We make no representation or warranty that any approval will be sought, granted or maintained, or that the development will proceed in any particular form or at all. All plans are subject to change, delay, phasing, substitution or abandonment in our sole discretion, without notice and without liability to you. Statements about future events are forward-looking and are not guarantees.

Nothing on this site is an offer to sell, a solicitation of an offer to buy, or a representation of pricing, availability, terms or timing. No statement here creates a contract, an option, a reservation or any interest in real property. Any transaction will be governed exclusively by a written purchase agreement signed by the parties, whose terms will control over anything on this site.

This site is void where prohibited by law. It is not an offer or solicitation in any jurisdiction where prior registration, filing, qualification or exemption is required and has not been completed, or where such an offer or solicitation would otherwise be unlawful. Interests in subdivided land may be subject to registration or disclosure requirements under the land-sales, subdivided-land and interstate land-sales laws of the state in which a prospective purchaser resides, and under federal law. Where those requirements apply, no offer will be made and no agreement accepted until they are satisfied.

We support and comply with the federal Fair Housing Act and Ohio’s fair housing law. All real property advertised on this site is available on an equal opportunity basis. Real-estate brokerage services referenced on this site are provided by the licensed brokerage named alongside the listing agent’s details. Nothing on this site creates an agency relationship between you and us, or between you and any brokerage or licensee, and nothing here is legal, tax, financial, engineering, surveying or investment advice. You should obtain your own professional advice before relying on anything shown here.

Except for the third-party material identified below, the text, layout, design elements and original photography on this site are owned by or licensed to The Orchard Reserve LLC and may not be copied, reproduced, republished, distributed or used to create derivative works without prior written permission.

Third-party marks and material

The following are the property of their respective owners, are used under the permissions and rules those owners set, and are expressly not claimed by us:

• The REALTOR^® mark, a registered collective membership mark of the National Association of REALTORS^®, used only by its members.
• The Equal Housing Opportunity logo, a mark of the U.S. Department of Housing and Urban Development.
• The name and logo of Choice Properties Real Estate, which belong to that brokerage.
• The listing agent’s photograph, which belongs to the agent and is used with her permission.
• Photography of Longview Cove, and any other image whose ownership or credit is held by a third party.
• Map imagery and tiles supplied by Esri, ArcGIS and their data contributors.

Photography credits and reservation of rights

Where a photographer credit exists, it is shown with the image, and we reserve all rights in, and make no grant of, any image for which a credit or licence is held by a third party. Where a credit is not yet confirmed, absence of a credit is not a claim of ownership. If you believe an image on this site is used without proper permission or credit, write to hello@theorchardreserve.com and we will investigate promptly.

This site links to websites and pages we do not control, including brokerage listing pages, social media pages operated by separate entities, mapping services and community organisations. Those links are provided for convenience. We do not endorse, adopt or take responsibility for third-party content, and your use of a third-party site is governed by that site’s own terms and privacy policy.

Listing and MLS information

Where this site references or links to property listings, including listings shown on brokerage or multiple listing service websites, that information originates with the listing brokerage or the MLS, is maintained by hand against a feed that changes without notice, and may be out of date, incomplete or withdrawn at any time. Price, status, availability, acreage and description must be independently verified with the listing brokerage. Listings referenced for comparison — including at Longview Cove, which is a separate community from The Orchard Reserve — are illustrative only and are not representations about The Orchard Reserve.

Editorial content on this site describes independent businesses, marinas, restaurants, public facilities and events around Indian Lake, sometimes including hours, payment methods, menus or dates. That information is described in good faith from public sources at the time of writing and changes frequently. We are not affiliated with those businesses, we do not control them, and we make no representation that any detail remains accurate. Please confirm directly with the business or organiser before relying on it.

You may not use automated means to access this site in a way that burdens our infrastructure, circumvents access controls, or harvests personal information. Crawling is permitted only in accordance with our /robots.txt file, and the summary at /llms.txt is provided so that answer engines can cite this project accurately.

To the extent liability cannot be excluded, our aggregate liability arising out of or relating to this site will not exceed one hundred U.S. dollars (US$100). Some jurisdictions do not allow certain exclusions or limitations, so parts of this section may not apply to you.

Your notice must identify the copyrighted work, identify the material you say is infringing and where it appears on this site, give your contact details, state that you have a good faith belief the use is not authorised, state under penalty of perjury that the information is accurate and that you are the owner or authorised to act for the owner, and be signed.

We will remove or disable access to material as required, and will notify the person who supplied it, who may submit a counter-notice under 17 U.S.C. § 512(g). We terminate access for repeat infringers.

These terms, and any dispute arising out of or relating to them or to this site, are governed by the laws of the State of Ohio, without regard to its conflict-of-laws rules. You and we submit to the exclusive jurisdiction and venue of the state and federal courts located in or serving Logan County, Ohio, and waive any objection to that venue.

Changes to these terms

We may revise these terms at any time. Changes take effect on posting, and the effective date below will change when they do. Continued use of the site after a change means you accept the revised terms.

Termination of access

We may suspend or terminate your access to this site at any time, for any reason, without notice.

Severability, waiver and entire agreement

If a provision of these terms is held unenforceable, it will be limited or removed to the minimum extent necessary and the remaining provisions will stay in force. Our failure to enforce a provision is not a waiver of it. These terms, together with our Privacy Policy, are the entire agreement between you and us about your use of this site and supersede any prior understanding about it.
