Privacy Policy

How this site handles the information you share with us.

Who we are

This website is operated by The Orchard Reserve LLC, an Ohio limited liability company (“we”, “us”), which markets The Orchard Reserve at Indian Lake. The Orchard Reserve LLC is the controller of the personal information described in this policy.

Privacy requests and questions about this policy: hello@theorchardreserve.com. Please use that address rather than any other contact shown elsewhere on this site, so that requests are logged and answered consistently.

What we collect

The early access and inquiry form

The inquiry form used on this site (including on the Request early access page) collects four required fields: your full name, email address, phone number, and your current city. Two further fields are optional: an inquiry type (private tour, buyer-agent or broker inquiry, or general question) and a free-text message of up to 1,000 characters. If you do not complete the four required fields, the form cannot be submitted.

The form also carries a separate, unticked consent checkbox. Ticking it is how you ask for project updates by email and, where you have given a phone number, calls or texts from the listing agent. It is never pre-ticked, and we record the exact consent wording shown to you and the time you gave it alongside your submission. Your phone number is used only to reply to you and, with that consent, for those calls or texts.

On submission we also record the page you submitted from, the first page you arrived on, the site that referred you, any campaign parameters in the link you arrived by (such as utm_source, utm_medium, utm_campaign, gclid and fbclid), your browser's user-agent string, and how long the form took to complete.

The form uses simple anti-spam measures: a hidden field that people do not see and do not complete, and a check on how quickly the form was submitted. Submissions that trip those checks are still stored, marked as suspected automated, and are not acted on.

The weekend planner

The Lake Life weekend planner can email you a plan you have built. That flow collects your first name and your email address. It also presents a separate, unticked marketing opt-in checkbox. Sending yourself a plan does not add you to any marketing list; only ticking that box does. If you tick it, we record your first name, email address, the consent wording and the time in the same inquiry store as the form.

Technical information

Our hosting provider records standard server log information when a page is requested, which may include IP address, user agent, requested URL, referrer and timestamp. This is used to serve the site, diagnose faults and protect against abuse.

Storage on your device

The weekend planner saves the plan you build in your own browser, using local storage under the key tor-weekend-plan-v1, so that your selections survive a page reload. That data stays on your device, is not transmitted to us by the act of saving it, and can be removed at any time by clearing the plan in the planner or clearing site data in your browser.

This site does not set advertising or cross-site tracking cookies; the only cookies are the Google Analytics cookies described below.

How we use it

  • To reply to your inquiry, and to arrange a private tour where you have asked for one.
  • To pass your inquiry to the listing agent so that she can reply to you.
  • To add you to the early access list and send you confirmed project updates about The Orchard Reserve, where you have asked to hear from us.
  • To send you the weekend plan you asked us to email you.
  • To keep the site working, secure and free of automated abuse.
  • To keep records we are required to keep, and to respond to legal obligations.

We do not sell your information, and we do not share it for cross-context behavioural advertising.

Cookies, analytics and third-party resources

This site uses Google Analytics 4, on the production domain only, to measure page views and interactions such as which pages and homesites are opened. It sets first-party cookies whose names begin _ga. We send no name, email address, phone number or message text to Analytics — our code strips those values before anything is sent. There is no advertising pixel, and no advertising or cross-site tracking cookies. Google processes the measurement data under its own terms.

Some resources are nonetheless loaded from third-party servers, and any request to a third-party server transmits your IP address, user agent and the page you are viewing to that server:

  • Web fonts are served from Google Fonts (fonts.googleapis.com and fonts.gstatic.com) on every page.
  • Map tiles are served from Esri ArcGIS (services.arcgisonline.com) on the pages carrying a map, which currently are the home page, Location and Lake Life.

Those providers process that information under their own privacy terms.

Service providers

We use the following providers, who process information on our behalf:

  • Resend — email delivery. Sends your confirmation and weekend-plan emails, and the alert that tells the listing agent an inquiry has arrived.
  • Supabase (hosted by Liftoff Local, our web agency) — the database in which inquiry and update-list records are stored.
  • Lovable — website hosting, serverless execution and server logs.
  • Esri / ArcGIS — map tile imagery.
  • Google Fonts — web font delivery.
  • Google Analytics — site usage measurement.

Liftoff Local, the agency that built and maintains this site, can access those records in order to operate it and support us. Where inquiry details are passed to the listing agent or the listing brokerage so that somebody can reply to you, that recipient handles your information under their own obligations as a licensee.

Lawful basis and consent

Where you submit an inquiry, we process your information because you asked us to respond to you, and because we have a legitimate interest in answering inquiries about the project.

Marketing email is separate. The weekend planner keeps its marketing opt-in as a distinct, unticked checkbox, so that asking for a plan is never treated as consent to marketing. You can withdraw consent at any time using the unsubscribe link in any message we send, or by writing to hello@theorchardreserve.com. Withdrawing consent does not affect processing already carried out.

How long we keep it

  • Inquiry form submissions: for as long as the project is being marketed and as needed to respond to you and keep a record of that correspondence.
  • Early access list membership: until you unsubscribe or ask us to remove you.
  • Server logs: for the period our hosting provider retains them, which we do not extend.

We may keep information for longer where a law, a regulation applicable to real-estate licensees, or an actual or threatened legal claim requires it.

Notice for California residents (CCPA/CPRA)

This section is our notice at collection for residents of California. In the twelve months preceding the effective date of this policy, we collect the following categories of personal information from this website:

  • Identifiers — name, email address, telephone number, city, and IP address.
  • Internet or other electronic network activity — pages requested, referrer and user agent in server logs, and analytics events about pages viewed and interactions on this site.
  • Commercial information — the nature of your inquiry and any message you write to us.

We collect it for the purposes described under “How we use it”, from you directly and from your device when you request a page. We disclose it to the service providers named above for those business purposes.

We do not sell personal information, and we do not share personal information for cross-context behavioural advertising. We do not have actual knowledge of selling or sharing the personal information of consumers under 16 years of age.

California residents may request to know, to access a copy in a portable form, to correct, and to delete personal information, and may not be discriminated against for exercising those rights. To exercise a right, write to hello@theorchardreserve.com. An authorised agent may submit a request on your behalf with proof of authorisation.

Rights in other states

Depending on where you live, your state may grant you rights over your personal information. Where a state law applies to us and to you, those rights generally include:

  • Confirming whether we process your personal information, and accessing it.
  • Correcting inaccurate personal information.
  • Deleting personal information you have provided.
  • Obtaining a copy in a portable, readily usable format.
  • Opting out of targeted advertising, the sale of personal information, and profiling in furtherance of decisions producing legal or similarly significant effects — none of which we carry out.
  • Appealing a refusal of a request, where your state provides for an appeal.

Ohio has no comprehensive consumer privacy statute in force, so this section rather than an Ohio-specific one describes the rights that may be available to you. Ohio law does require notification of certain security breaches involving personal information, under Ohio Revised Code section 1349.19, and we will notify affected individuals as that section requires.

Making a request

Send requests to hello@theorchardreserve.com. So that we do not disclose information to the wrong person, we will verify your request by matching the details you give us against what we hold — normally the email address you used, and the name submitted with it. We may ask for one further piece of matching information. We do not use a verification step to collect anything new. We aim to respond within 45 days and will tell you if we need longer.

Children

This site is not directed to children under 13, and we do not knowingly collect personal information from them. If you believe a child has given us information, write to hello@theorchardreserve.com and we will delete it.

Security

The site is served over HTTPS, and inquiry records are held in a database that only signed-in project staff and our web agency can read. No method of transmission or storage is completely secure, so we cannot guarantee absolute security. Please do not send sensitive personal information, financial account details or identification documents through the forms on this site.

International transfers

We operate in the United States, and the providers named above process information in the United States and, in the case of content delivery and email infrastructure, potentially in other countries. If you use this site from outside the United States, you understand that your information will be processed in the United States, where data protection law may differ from the law of your own country.

Automated decision-making

We do not carry out profiling or automated decision-making that produces legal or similarly significant effects about you. Inquiries are read and answered by people.

Effective date and changes

This policy is effective from 4 September 2026. We may update it as the project, this website or the law changes. Changes take effect on posting, and the effective date above will change when they do. Where a change is material, we will say so on this page.
